COPYRIGHT INFRINGEMENT POLICY
Pancho, Inc. respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.
DMCA NOTICE FOR HOSTED WEBSITES
As a shared hosting provider, Pancho, Inc. hosts websites created and maintained by our users. We do not actively monitor, review, or edit the content of these websites. If you believe that material or content residing on or accessible through a website hosted on our platform infringes your copyright, please send a notice of copyright infringement to our designated agent listed below.
HOW TO FILE A DMCA NOTICE
You can request the removal of any material which is copyrighted by you. If you find such material either posted on our website or on a website hosted on our platform, you can contact us and ask for removal. The following elements must be included in your copyright infringement claim:
1. Provide evidence of the authorized person to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Provide sufficient contact information so that we may contact you. You must also include a valid email address.
3. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
4. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
5. Must be signed by the authorized person to act on behalf of the owner of an exclusive right that is allegedly being infringed.
6. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
7. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (preferably including the specific URL where the material appears).

Emailing your complaint to other parties such as our Internet Service Provider will not expedite your request and may result in a delayed response due to the complaint not properly being filed.
Please allow 2-3 business days for processing and removing copyright material.
OUR RESPONSE TO DMCA NOTICES
Upon receipt of a valid DMCA notice, Pancho, Inc. will:
- Remove or disable access to the content identified in the notice;
- Forward the written notification to the alleged infringer;
- Take reasonable steps to promptly notify the alleged infringer that we have removed or disabled access to the content.
COUNTER-NOTIFICATION
If you believe that your content that was removed or to which access was disabled is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our copyright agent:
1. Your physical or electronic signature;
2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
3. A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content;
4. Your name, address, telephone number, and email address;
5. A statement that you consent to the jurisdiction of the federal court in the district where you reside, or if you reside outside of the United States, the jurisdiction where Pancho, Inc. is located;
6. A statement that you will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notification is received by our copyright agent, we may send a copy of the counter-notification to the original complaining party informing that person that we may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.
REPEAT INFRINGERS
Pancho, Inc. maintains a policy of terminating the accounts of users who are repeat infringers of copyright. If we receive multiple valid DMCA notices regarding a user's website, we may terminate that user's hosting account in accordance with our Terms of Service.
MODIFICATIONS TO POLICY
Pancho, Inc. reserves the right to modify this Copyright Infringement Policy at any time. Changes and clarifications will take effect immediately upon their posting on the website. We encourage you to periodically review this policy to stay informed of how we are helping to protect the intellectual property rights of others.
